Will

This is the Last Will and Testament of me Thomas Grenfell of the Parish of Madron in the County of Cornwall Yeoman. And first it is my will and desire that in case my present wife Mary Grenfell should survive me she shall have dring her life so long as she shall continue my widow the use of and occupy the House in which we now live and I will and direct that she shall be supported and maintained by my son Henry Grenfell of the same place Yeoman as a part of his family but in the event of her wishing to live apart from my said son Henry Grenfell but not otherwise that then she shall have and enjoy the Interest of all monies which may be due to me on certain Promissory notes and I further will and direct that if my said wife shall so live apart as aforesaid but not otherwise that then my said son Henry Grenfell shall pay her likewise the clear yearly sum of Five pounds which said sum I make payable out of my Leasehold Estate situate at New Bridge in the Parish of Sancreed and which I now hold of the Honourable A.M.Agar under and by virtue of two several Leases dated respectively and determinable as therein mentioned, and to be paid by four equal quarterly payments, namely, at Ladyday Midsummer Michaelmas and Christmas, the first quarterly payment to be made on such of the said days as shall first happen after my decease. And in case such annual sum or any part thereof shall be in arrear that then my said wife shall be at liberty to enter into and upon my said Leasehold Estate and destrain for the same or or such part thereof as may be in arrear for the space of 21 days in the same manner as for rent reserved on common demises.

Also, I give and bequeath unto my Daughter Mary Grenfell the annual sum or yearly rent charge of Five Pounds of lawfyl money of Great Britain clear of all deductions whatsoever and likewise issuing and payable out of the herein before described Leasehold Estate at New Bridge payable quarterly, and I hereby give my said daughter and her assigns such powers of entry and distress and sale upon the said Estate for recovering such annual sum or Rent charge of £5 if the same or any part thereof sgall be in arrear for the space of 21 days after any of the days of payment as are usually given to Landlords for recovering Rents reserved by lease or on common demise such sum to be paid unto my said Daughter twelve Calender months after the decease of my said wife. Also I further give and bequeath unto my said Daughter Mary Grenfell the Dwelling House now in the occupation of my son Henry Grenfell together with the garden attached to the said House and also the pigstye and dungpit thereto belonging and a plot of ground ( of the same dimensions as the plot on which a furze rick now stands for the purpose of making her furze and tirf rick on) all which premises are part and parcel of my Leasehold Estate at New Bridge to hold the same for the term of her natural life, and I give the same together with the said Yearly Rent charge of £5 unto my said Daughter Mary independent of and not to be subject or liable to the control debts or arrangements of any husband she may have, but if my said Daughter Mary should depart this life unmarried and without lawful issue then I give and bequeath the whole of the said Dwelling House, Garden, Pigstye, Dungpit and plot of ground for furze and turf rick unto my son Henry Grenfell. And should my Daughter Mary outlive the two lives now in existence under the original Lease of the whole of the Premises now in my possession then I direct that she shall pay one third of the high rent due upon the whole of the aforesaid premises and payable under a certain reversionary lease of the same premises granted to my son Henry Grenfell. Also I give and bequeath unto my Daughter Grace the wife of William Hall of the same Parish Yeoman the Dwelling House now in the occupation of one John Hall of the same parish Shoemaker and also half the garden thereto attached Together with the Dungpit pigstye and a plot of ground of the same dimensions as the plot on which a furze rick now stands for thepurpose of making her turf and furze rick on. Likewise I give unto my said Daughter Grace Hall the shoemakers shop adjoining to the said Dwelling House the whole of which premises are part and parcel of my Leasehold Estate at New Bridge and I give the same several premises to my said Daughter Grace independent of and not to be subject or liable to the control debts or arrangements of her present or any future husband or husbands. Also I give and bequeath unto my Daughter Hannah Grenfell the sum of £10 of lawful money of Great Britain and Ireland the same to be paid to her within twelve Calender months after the decease of my wife. Likewise I give and bequeath unto my said Daughter Hannah Grenfell the Dwelling House now in the occupation of William Hall together with the other moiety or half part of the garden attached to the Dwelling House now occupied by the said John Hall and also one lace of ground behind the same for furze rick and turf rick together with the dungpit and pigstye belonging to the same premises the whole of which premises are part of my Leasehold Estate at New Bridge, and give the same together with the said sum of £10 to my said Daughter Hannah Grenfell independent of and not to be subject or liable to the control debts arrangements of any husband she may have now or hereafter., but if my said Daughter Hannah should die unmarried and without issue, I then give and bequeath the aforesaid Premises to my said son Henry Grenfell And all the rest, residue and remainder of my Estate and Effects real as well as personal and wheresoever situate I give devise and bequeath unto my son Henry Grenfell of New Bridge Yeoman subject to the payment thereout of the pecuniary legacies bequeathed by this my will and also to the wishes and directions hereinbefore contained. And I hereby nominate and appoint my said son Henry Grenfell the sole Executor of this my last will and I do hereby revoke all former and other wills and codicils heretofore made by me at any other time or times and declare this only to be my last will and testament. And if it should happen that my son Henry Grenfell should die in my lifetime I give, devise and bequeath all the real and personal property which I have bequeathed to my said son unto my Friend Mr.Bernard Victor of Sellan in the Parish of Sancreed Gentleman upon Trust to hold the same for the use of my two Grandsons Thomas Grenfell and Henry Grenfell the sons of my son Henry Grenfell and Blanch his wife until they shall respectively attain the age of 21 years share and share alike but subject to the hereinbefore mentioned pecuniary legacies of £10 and the two several Rent charges of £5 each payable to my widow and my Daughter Mary respectively and all other the condition and directions hereinbefore contained.

In the Archdeaconry Court of Cornwall In the Goods of Thomas Grenfell late of the Parish of Madron Yeoman deceased. Appeared personally James Pascoe of the Town of Penzance in the County of Cornwall, Gentleman and made oath that in the year one thousand eight hundred and forty eight Henry Grenfell of New bridge in the Parish of Madron, Miller, brought to the Office of this Department written instructions for the last Will and Testament of his Father Thomas Grenfell of the same place Yeoman which Will wasduly prepared. That on or about the eighth day of March One thousand eight hundred and forty nine as by a book of entries in the Office of this Department appears, the said Henry Grenfell and his said Father thesaid Thomas Grenfell clled at this Departments Office when the Will was read over to the said Thomas Grenfell, certain alterations therein were made, and afterwards such Will was duly signed by the said Thomas Grenfell and attested by this Departments then Managing Clerk Thomas Jenkin and another Clerk called Francis Hosking, which Will this Department verily believes to be the paper writing hereunto annexed Marked (A). And this Department having now carefully viewed and inspected the said Will further saith that the whole series and contents thereof with the several interlineations are all in the hand writing of his Clerk the said Francis Hosking and that the names Thos.Jenkin and F.Hosking thereunto subscribed as witnesses to the due execution of the said Will and the Initials T.J. and J.H. set opposite each intrelineation and erasure are in the respective handwritings of the said Thomas Jenkin and Francis Hosking. And this Department further saith that the said Thomas Jenkin died on or about the sixth November One thousand Eight hundred and Fifty One and that the said Francis Hosking went to Australia about the sixth October One thousand eight hundred and fifty two and is now resident out of this Kingdom as this Department verily believes.

Will

John M. Collins, Vicar of Sancreed.

This is the last Will and Testament of John Grenfell, Carpenter, of the Parish of Sancreed in the Countyof Cornwall.

I give, and bequeath to my dearly beloved wife, Elizabeth Grenfell, for the term of her natural life, an Annuity of Twenty Five Pounds , to be paid her quarterly, on the usual quarter days; and the first payment to be made on the first quarter day which shall happen after my decease, and to be issuing, due, and payable out of my Estate called Trannack Mill, and out of my Premises at Chapel Place, situate in the Parish of Sancreed, together with sufficient household furniture for one person.

I give and bequeath, to my son John, for the term of his natural life, two annuities, One of Eight Pounds, to be paid to him quarterly, on the usual quarter days, and the first payment to be made on the first quarter day which shall happen after my decease; and another of Six Pounds to be paid to him quarterly, on the usual quarter days, and the first payment of this last annuity to be made on the first quarter day which shall happen after his Mothers decease, and to be issuing, due, and payable out of my Estate called Trannack Mill, and out of my Premises at Chapel Place, situate in the Parish of Sancreed aforesaid.

I give, and bequeath, to my daughter Elizabeth, for the term of her natural life, an Annuity of Six Pounds, to be paid to her quarterly, on the usual quarter days, and the first payment to be made on the first quarter day which shall happen after my decease. I charge this annuity on my Premises situate at Newlyn, in the Parish of Paul.

I also give, devise, and bequeath to my son George Grenfell, whom I constitute, make and ordain, the sole Executor of this my last Will and Testament, and residuary legatee; All and Singular my Lands, Tenements and Messuages, and all other Property whatsoever, and wheresoever, and of what kind soever the same may be, by him freely to bepossessed and enjoyed for his own absolute use. And I charge my Executor to pay all my just debts, dues, and demands, and each and every of the before mentioned Annuities. In Witness whereof I have hereunto set my hand and seal this fourth day of June, in the year of our Lord, one thousand eight hundred and forty two.
