Isaias the holy phrophet of God: was sent of the Lord God, to speake to Esachias the king of Inda; being sicke unto death, saing: Thus comandeth the Lord God. Set thine house in order: for thou shalt dye and not live: in likemaner: Saint Austyn gave most excellent aforewarning: to thee that be in extreme sicknes: saing. Know all men by these presents that Dorothy Murley of the parish of Phillack in the County of Cornwall Widow and Administrator of William Murley late of the same parish yeoman dec.d. Sendeth greeting Know yee that the said Dorothy Murley for diverse good Causes and Considerations the said Dorothy Murley hereunto moveing hath relinquished and renounced and in and by these presents both relinquished and renounced all the rights of Administration of in and unto the Effects and Effects of the said William Murley dec.d. So any Administration thereof be granted and comitted unto William Murley and John Murley sons of the said William Murley dec.d. In the name of God Amen I William Murley of the parish of Phillacke in the County of Cornwall yeoman being infirm and weak in body but of sound and perfect mind and memory, praised be to Almighty God for the same, and calling to mind the Certainty of Death and the Uncertainty of its coming do hereby recommend my soul into the hands of Almighty God my Creator, in and through the all sufficient merits of my Compassionate Redeemer Jesus Christ, and my body to a Decent and Christian Burial at the Discretion of my Executors hereafter named and as for my worldly Effects I dispose thereof as follows.
I give and devise unto my Eldest Daughter Dorothy Murley and her heirs forever all my fee simple Estate in Phillack Church Town, I also give ane bequeath to my said Daughter Dorothy my Estate in Coswinsausin within the parish of Gwinear in the said County of Cornwall during my Estate and Interest therein; I also give and bequeath to my said Daughter Dorothy my Estate in Penhale within the said parish of Gwinear in the said county of Cornwall during my Estate and Interest therein. I also give and bequeath to my said Daughter Dorothy my Estate in Barnoon within the parish of Phillacke in the said County of Cornwall during my Estate and Interest therein; I also give and devise unto my said Daughter Dorothy and her heirs forever my one forty eighth part in Herland in the parish of Gwinear. I also give and bequeath unto my said Daughter Dorothy one half of my Estate in Godrevy within the parish of Gwithian in the said County of Cornwall during my Estate and Interest therein.
I give and bequeath unto my Youngest Daughter Mary Murley my Messuage Estate and Tenement called Tremellyn ; and two Tergooses All within the parish of Saint Erth in the said County of Cornwall during my Estate and Interest therein; I also give and bequeath unto my said Daughter Mary one half of my Estate in Godrevy within the parish of Gwithian in the said County of Cornwall during my Estate and Interest therein. I also give and bequeath to my said Daughter Mary my Estate in Tringee within the said parish of Phillacke in the said county of Cornwall during my Estate and Interest therein, I also give and devise unto my said Daughter Mary, and her heirs forever my one forty eighth part in Herland in the parish of Gwinear.
I give and bequeath unto my wife Joanna Murly one Annuity or yearly payment of Twenty pounds clear of all outgoings payable by Quarterly payments at Lady Day Midsummer Michealmas and Christmass in Equal portions the first payment thereof to be made at such of the said days as shall first happen next after my death, such payment to be made by my said two Daughters, Dorothy and Mary in Equal portions out of my Estate and Effects given them by this my last Will and Testament (On condition she relinquishes her right of Dower and Thirds) and I hereby subject and render lyable my Estates and Effects to the payment thereof with power of making Distress for the same in case of Nonpayment thereof.
All the rest of my Goods Chattles and Personal Estate wheresoever situate I Give Demise and Bequeath unto my said wife Joanna Murley whom I nominate and apoint Executor of this my last Will and Testament but in Trust only and for the only use and benefit of my said two Daughters, I also desire and request my said wife to Carry on my Twenty fourth part in Herland aforesaid and to Adventure the same for the Benefit of my two Daughters, and to Manage inspect and Direct all my Estates and Effects for them as aforesaid for their use and Benefitt, and my will and meaning is that my said Trustee and Executor shall not be accountable for any loss which may happen by means of her acting in the Execution of the trust hereby reposed in her saving what may be willfully and designedly be done. In Witness whereof I have hereunto sett my hand and seal and published and declared this paper reciting and for my last Will and Testament this fifth day of May in the year of our Lord one thousand seven hundred and fifty eight.
