Nuncupative Will

In the name of God Amen John Chinhale of the prish of St.Just in Penwith within the County of Cornwall Blacksmith being of pfect and dsiposing memory made and declared his last will and testament nuncupative the twenty first day of Ffebruary Anno Dom ---- ---- 1647 in manner and forme following.

Ffirst he bequeathed his soule to God, and his body to Christian buriall.

Item, he gave unto Alice his daughter, and her two children three ewes.

Item, he gave unto William Chinhale and Thomas Chinhale his sonnes, two paire of billowes, two anvells and all his working tools.

Item ,he gave and bequeathed unto George Chinhale his Grandson one heafer and his best suite.

All the rest of his goods and Chattails not before given and bequeathed, his debts being paid, and his funerall expenses discharged, he gave and bequeathed unto William Chinhale, and Thomas Chinhale his sonnes and Jane Chinhale Widdow his daughter in law, whome he nominated costituted and appointed to be his executors these being then and there present.

Will

In the name of God Amen I John Chinhalls of the parish of St.Just in Penwith in the County of Cornwall Yeoman being weak in body but of Sound, Disposing Mind and Memory, Thanks be given unto God for the same, and calling unto mind the Mortallity of my body and knowing that it is appointed for all Men once to die Do hereby make this my last Will and Testament in Manner and form following/ That is to say/ First and principally I Recommend my soul into the Hands of Almighty God that gave it me, Nothing Doubting but to Receive the same again at the General Day of the Resurection, Through the Merits of my Blessed Redeemer Jesus Christ. And my body I Recommend to the Earth to have a decent Christian Burial at the Discretion of my Executor herein after named. And as touching such Wordly Goods wherewith it hath pleased God to bless me with in this life. I hereby give, Devise and Bequeath in Manner following.

Impr. I hereby Give and Bequeath to my Dearly beloved Wife Alice Chinhalls During her Natural Life the old Kitchin in the House I now live in Nancherrow, with the two chambers over the same, with the two beds therein with all the ffurniture to them severally belonging as they now stand, with the chamber over the ffront kitchin, with all other household goods as she shall want for her own use at her choice with halfe of the kitchin garden and Likewise free and Undenyable Liberty for her to keep pigs, geese and other fowls at her will and pleasure, And also Liberty without Denyal on any convenient place she shall chuse to Make her Furse and Turf, And to take fruit from my Orchard in Nancherrow aforesaid for hrer own use with Liberty of Quietly Passing and Repassing to the said Rooms and Orchard, In case she Continues to Reside and Live in Nancherrow aforesaid with my Executor hereinafter named and Remain a Widow but not otherwise. And Likewise I hereby further give to my said Wife During her natural life All my Chattle Estate in Kenis Vean in the Parish of Paul, And my Chattle Estate in Trevillo in the said Parish of Paul during her life, in casemy present Estate shell therein so long continue with full Liberty and Authority for her to Take, Ask and Receive the rents thereof to her use, and to use any lawfull means for the recovery thereof, from and immediately after my death, And from and immediately after her death Trevills [?] is to Desend to my Executor, And further I hereby give to my said Wife the full proffit of a Cow yearly and every year during her life, the same Cow to be kept constantly in the fields with my Executors cows free of all charge whatsoever.

Item, I hereby Give and Bequeath to my son William Chinhalls the sum of thirty pounds of lawfull money of England to be paid him by my Executor on the several times herein aftermentioned / that is to say/ the sum of ten pounds three years after my death, and not before, and from thence ten pounds at the end of every ensueing year till the same is paid, in case he shall live so long but not otherwise And also I hereby give him One Twentyeth part Original Adventure with its Toolls Tackle and Tribute to the same belonging throughin and throughout South Carn Liskis Adit Sett [?]. He paying all cost that shall become due on the same after my death.

Item, I hereby Give and Devise to my Daughter Honour/ the now Widow of James Tregear/ the sum of twenty five pounds,the first payment of which is to be ten pounds I hereby will to be paid her in case she is living but not otherwise three years after my death, And from thence the one half of the remainder every ensueing year till the same is fully paid, if she live so long, but not otherwise.

Item, I hereby Give and Devise to my two daughters Margaret, the now widow of Richard Oats and Grace Chinhalls spinster the sum of twenty pounds each.The first payment thereof which is to be ten pounds each is to be sepereatly paid them at the end of three years as aforesaid , in case each of them is living to whome it is due but not otherwise, and from thence the one half of the remainder at the end of every ensueing year till the same is sepereatlty paid, if they live so long but not otherwise. Together with sufficient and convenient Meat, Drink , Washing and all sorts of necessary Apparell as they shall want during such time as they shall live with my Executor and they are to do the same to my Executor, All customary House Work as they now do for me. And I hereby further give them equally between them the full proffit of Cow, from and immediately after the death of my said Wife and to be kept as my Wifes is to be kept during their singlehood, And in case, the one Marrys, the other being single she is to have the full proffit, And if both Marrys, the proffit to return to my Executor. Likewise I hereby give them equally between them the Bed and Beding they now lye on, And further in case both or either of them goes off from my Executor to live they are to have the House and Garden that Richard Tinner now lives in during their single life My Executor to Repair the house, with household goods at the discretion and judgement of my Executor.

Item, I hereby Give to my son Edward Chinhalls Five pounds, The one half to be paid him at the end of one year after my death and the remainder at the end of the next year if he is then living but not otherwise , with one shilling to his Wife Rachall. And I hereby give One Shilling each to as many of my Grandchildren as shall be living at my death.

And Lastly, All my ffee simple and Lands of Inheritence, in St.Just Church Town/ otherwise Lafrowda and in Nancherow I hereby Give, Devise and Bequeath to my son John Chinhalls, To Hold to him and to his Heirs for ever. Together with all other my Chattle Estates in Chywoon or elsewhere that I shall dye possessed of and not herein before given with all my Household goods and not herein before given with all other my Chattles and Effects whatsoever I hereby Give, Devise and Bequeath to my said son John Chinhalls Whome I hereby also Constitute, Nominate and Appoint whole and sole Executor of this my last Will and Testament. He paying all my Just Debts Legacys and Funeral Charges, Hereby Ratifying, Allowing and Confirming this and no other to be my last Will and Testament and by these presents making all other wills void. In Witness whereof I have hereunto sett my Hand and Seal in the presence of the Witnesses this Twenty fourth Day of October in the year of our Lord one thousand seven hundred and seventy ffour

By Gods Permission I William Chenhalls of the Parish of St.Just in Penwith in the County of Cornwall Yeoman being sick and weak in body but of sound perfect and well Disposing Mind and Memory/Thanks be to God/ Do make this my Will in Manner Following.

First, I comend my Soul into the Hands of Almighty God hoping for an happy Resurrection at the Last Day thro' the Mercys of God and the Mediation of Christ, my Redeemer, and my body to Christian Burial at the Discretion of my Executor herafter named.

Also, I give and bequeath to my Dearly beloved Wife Sarah Chenhalls the Sum of ten pounds yearly by quarterly payments to be computed from the time of my death and to be issuing and payable out of my ffreehold Estate in Treeve in the Parish of St.Buryan during her natural life; The said annuity being charged thereon and payable to her out of the said Tenement of Treeve by way of Jointure by Virtue of Articles previous to our marriage and I do give and bequeath to my said wife during her natural life the further sum of two pounds yearly by quarterly payments to be computed from the time of my death and to likewise issuing and payable out of my said freehold Estate called Treeve And my Will is that in case the siad annuitys, or either of them, shall not be fully and only paid as above is directed the said Sarah Chenhalls, Her Executor, Admons or Assigns shall have full power and authority in and upon the said Tenement of Treeve to enter and distrain for the same with the arrears thereof, if any, and the Distress there found to take impound and sell as in caes of Distress for Rent.

Also, I give to my said Dearly beloved Wife Sarah Chenhalls all the Household Goods, os what kind or sort soever, of which I shall dye possessed.

Also, I give and bequeath to my Daughter Jane Chenhalls the Sum of six pounds yearly by quarterly payments to be computed from the time of my death during her natural life to be issuing and payable out of my FreeholdEstate called Menallack in the said parish of St.buryan with full Liberty and authority, in case of non payment thereof as above, to and for the said Jane Chenhalls her Executors Admons or Assigns in and upon the said Tenement called Menallack to enter and Distrain and the Distress there found to take impound and sell as in cases of Distress for Rent. Also, I give to my said Daughter Jane Chenhalls the sum of twenty pounds to be paid her by my Executor hereafter named at the end of one year after my death.

Also, I give to my Daughter Elizabeth, the Wife of Thomas Woolcock /for her sole and separate use and independent of her said Husband / the sum of five pounds yearly by quarterly payments to be computed from the death of my said Wife during her natural life and to issuing and payable out of the said Tenement of Treeve with full Liberty of Distress as is above mentioned with respect to theother Annuitys above given.

Also, I give to my said Daughter Elizabeth/ and for her like sole and separate use and Independent of her said Husband/ the sum of twenty pounds to be paid her by my Executor at the end of one year aftre my death.

Lastly, All my said Freehold Estates called Treeve and Menallack and all other the Lands, Tenements,Goods, Chattles, Effects and Substance whatsoever of which I shall dye possessed , subject to my just debts ffuneral charges and to the several legacys and annuitys above given, I give devise and bequeath to my son William Chenhalls whom I do hereby appoint sole Executor of this my Will. In Witness whereof I have hereto sett my Hand and Seal this fifth day of March in the year of our Lord One thousand seven hundred and seventy six.
