Nuncupative Will

Memorandum That on or about the first ady of April, 1749 William Weymouth of the Parish of Borean [St.Buryan] in the County of Cornwall yeoman being then sick of the sickness whereof he dyed, being of sound and perfect mind Memory and understanding and having an Intent and Purpose to make his last Will and Testament Nuncupative or by word of Mouth did Devise- Otho Popham [?]- James Gout and Richard Board, who were then in the room where he then lay sick to take notice of what he should say or declare and that the same might contain his last will and Testament Nuncupative or by word of Mouth as aforesaid and accordingly the said Otho Popham according to the Desire of the said William Weymouth reduced the words into writing following (To Witt) All that I shall Dye possessed of I Give and Bequeath to John Curnow Jnr., and William Hutchins whome I make Constitute and appoint whole and sole Executors they Paying my Debts and Funeral Expenses, which words or words to the same Effect was Spoke by the said William Weymouth in the presence of the said Otho Popham, James Gout and Richard Board and he then desired them to take Notice that the same might be and Contain his last Will and Testament Nuncupative or by word of Mouth and the said William Weymouth deceased was at all and singular the ---misses [?] of sound and perfect mind memory and understanding and well understood what he said and did,

Declaration

Also the said William Weymouth ---- ---- severall ----- declared to the said Otho Popham and James Gout after the first his said Declaration which the said Otho Popham first reduced into writing and ---- ---- herein that he desired them that what he said and declared the said first day of April was his Last Will and Testament by word of mouth.

In the Name of God, Amen. I James Weymouth of the Parish of St.Buryan in the County of Cornwall Yeoman being at this Time indisposed in Body but of sound mind memory and Understanding thinks be given to Almighty God for the same And calling ot mind the mortality of this my Body which I hope to resign into the hands of my Almighty Creator hoping to obtain a happy resurrection through the merits of my Lord Saviour Jesus Christ And as touching such wordly estate wherewith it hath pleased God to bless me in this life I give and bequeath the same in the following manner That is to say.

First. I give and bequeath unto my dearly beloved Wife if she survives me the sum of one Guinea in Gold over and above her marriage settlement to be paid her one month after my decease by my Executor hereinafter after named.

Also, I give and bequeath unto my Daughter Mary the sum of fifty Pounds to be paid her when she shall attain the age of twenty four years by my Executor hereinafter named.

Also, I give and bequeath unto my Daughter Anne the like sum of fifty Pounds to be paid her at the Age of Twenty four Years as aforesaid.

Also, I give and bequeath unto my Daughter Thomasin the like sum of Fifty Pounds to be paid her at the Age of twenty four years as aforesaid.

Also, I give and bequeath unto my Daughter Grace the like sum of fifty pounds to be paid her at the Age of twenty four years as aforesaid.

Also, I give and bequeath unto my Daughter Elizabeth the like sum of fifty pounds to be paid her at the age of twenty four years as aforesaid.

My will is that my said Daughters live with their Brother if they chuse it during their Childhodd or minority and that he provide for them maet drink wearing Apparel and all necessaries in a decent manner till they arrive in age or marry and that free and clear of any charge to them to be counted as a reward for their service to him.

Lastly, I give and bequeath unto my Son James Weymouth all the rest Residue and Remainder of my Estate Goods, Chattels and Effects of what nature kind or sortsoever (But subject to the payment of the aforesaid Legacies as they shall become due and payable on the times aforesaid And subject to the payment of all my just Debts and Funeral Charges) And I do hereby nominate and appoint my said Son to be the whole and sole Executor of this my last Will and Testament ratifying and confirming this and nother for the same. In Witness whereof I have to this my said last Will and Testament written on two Sheets of Paper to the first of which said sheets I have subscribed my name and to this last set my Hand and Seal the twenty second day of January In the Year of our Lord one thousand seven hundred and ninety three.

In the Name of God Amen

I Henery Weymouth of the Parish of St.Buryan in the County of Cornwall Yeoman being at this time of sound mind Memory and Understanding, Thanks be given to Alnighty God, for the same, And calling to mind my Mortality do in the faer of the Lord, make and ordain this to be my last Will and Testament.

Vizr.

First, I give and bequeath unto Jane, my Dearly beloved Wife, if out lives me my Bed and Bedding Complete and as much Household Goods as will furnish a Room for one person, And the sum of eighty pounds to be Paid in six Months after my Decease, by my Executor hereinafter named, and one part of my Leasehold House in Buryan Church Town, the Rooms called by the name of, the Kitchen, Chamber and Hall, and free liberty of Coming and Going to the same without any dispute or Hinderance of any person whatsoever.

Also, I give and bequeath unto my Son Ephraim Weymouth, One hundred and Twenty Pounds in Cash to be paid him by my Executor hereinafter named.

Also, I Give and bequeath to my Daughter Mary, the Wife of Robert Gibbs, ten Pounds and the Reversion of Joseph Gibbs House in Church Town during her life Time, and then to her Son William Gibbs and Twenty pounds when he shall attain the age of twenty one Years.

Also, I give and bequeath to my Daughter Sarah the Wife of John Tregortha the sum of Thirty Pounds, to be paid her in Six Months after my Decease by my Executor hereafter mentioned.

Also, I give and bequeath to my Daughter Jane the Wife of Charles Jacka, the sum of Thirty pounds , to be paid her as aforesiad.

Also, I give and bequeath to my Daughter Margery the Wife of William Thomas the sum of Thirty pounds to be paid her as aforesiad

Also, I give and bequeath to my Son William Weymouth the sum of Forty pounds to be paid him as aforesaid.

Also, I give and bequeath to my Daughter Ann Weymouth the sum of Forty pounds to be paid her as aforesaid.

And, I do hereby make and ordain my Son Henery Weymouth the Executor of this my last Will and Tetsament and Residuary Legatee of the same. He paying thereout the aforesaid Legacies and all my just Debts, In Witness wherof I have hereunto set my Hand and Seal this Twenty Third day of May One Thousand Eight Hundred and eleven.

This is the last will and Testament of me, John Weymouth of the Parish os Saint Buryan, in the County of Cornwall, Gentleman.

First, I give and bequeath, unto my Sister, Sarah Weymouth, All that my Leasehold Tenement, with the Apputenances, situate in Selena, in the said Parish of Saint Buryan, called Rowes Tenement, the freehold of the Earl of Falmouth, and on which my said sister and myself, are the only now existing lives. To hold the same unto my said sister Sarah Weymouth, and her Assigns, from and immediately after my death for and during the remainder of my Term Estate and Interest therin. Subject to the Covenants reservations and agreements contained in the Lease of the said premises by virtue of which I hold the same tenement.

Also, All my Messuages, Lands, Tenements, and Hereditaments, as well, ffreehold as Leasehold, if not hereinbefore bequeathed, and all the rest residue and remainder of my personal Estate and effects, whatsoever and wheresoever, I give devise and bequeath the same, and every part thereof, respectively, unto my good friends, John Permewan, the Younger, of the Parish of Sennen, in the said County,Gentleman, and Richard Dennis, of the Parish of Madron, in the same County,Gentleman; To Hold to them , and the survivor of them, his heirs, Executors, Administrators and assigns, respectively, from and immediately after my death; In trust, nevertheless, and so and for the several uses, ends,intents and purposes hereinafter mentioned , declared, limited and appointed of and concerning the same, that is to say. In trust, that the said John Permewan and Richard Dennis, and the survivor of them, his Heirs, Executor, Administrators or Assigns, respectively, shall and do, as soon after my death as convenient by maybe of their, or his own proper authority, proceed either by public auction, or private contract, as they or he shall think fit, to sell and dispose of, and convey in ffee simple, All and singular my Messuages, Lands, Tenements,Hereditaments and premises in or called Sparnon, Chinance and Chivarton, situate lying and being in the said Parish of Saint Buryan; Treene in the Parish of Saint Levan, in the said County, and all other my Hereditaments and premises, of which I shall die possessed, with their and every of their appurenances. And also so sell and dispose of, grant and assign, All and singular My Leasehold Tenements and premises, with the appurtenances, and all my Chattel property and effects, or a sufficcient and competent part aparts thereof respectively to raise a sufficcient sum of money, in the first place, for the purpose of paying off and discharging my funeral expenses, the costs of proving this my will, and the expenses attending such slae or sales and exceeding the Trusts hereof; And also all and singular such debts as, and in the judgment and opinion of the said John Permewan and Richard Dennis, and the survivor of them, his Heirs, Executors, Administrators or Assigns, may bejustly and reasonably due and owing from me at the time of my death, either specially or by simple contract and in the next place for the purpose of raising the sum of Three Hundred Pounds , of Lawful English money, which I do hereby give and bequeath unto my Grand daughter Elizabeth Weymouth Kelynack, the Daughter of my late Son in Law Thomas Richards Kelynack, deceased, and my Daughter Elizabeth Kelynack Widow, to whom I direct the same legacy shall be paid on her attaining the age of twenty and one years, or day of marriage which shall first happen, and I direct that the Interest thereof shall, in the mean time, be paid and applied in and towards the Maintenance and education of my said Grand daughter according to the direction of and by the Trustees and Executors, In Trust, of this my Will. And I do hereby order and direct that such sale or sales shall and may be made either together or in parcels for such price, or prices, as at the time of such sales, can in the Judgment or opinion of the said John Permewan and Richard Dennis, or the survivor of them, his heirs, Executors, Administrators or Assigns, be reasonably had or gotten for the same, to such person or persons as shall be willing to purchase the same, who, having paid his, her or their purchase money, or monies, to and obtained a receipt or receipts for the same from the said John Permewan and Richard Dennis, or the survivor of them, his heirs, Executors, Administrators or Assigns, shall be by such receipt or receipts fully acquitted and discharged from such purchase money or monies, or any of them, as much thereof as in such receipt or receipts shall be expressed to be received; and shall not affect and be liable to fee to the application of the same, or answerable for the loss, this application or new application thereof; And from and after payment and discharge of the said expenses charges debts and legacy of Three Hundred pounds, and the Interest thereof, to my said Daughter, and subject thereto, I do hereby order and direct that the said John Permewan and Richard Dennis. and the survivor of them, his heirs, Executors, Administrators and Assigns respectively, share and do stand seized and be possessed of such part of my Real and personal Estate and Effects as shall then remain undisposed of for the purposes aforesaid In Trust nevertheless and to and for the only proper use benefit and behof of my two daughters the said Elizabeth Kelynack and Mary Weymouth to whom I give devise and bequeath the same, To Hold to them, in equal moieties share and share alike , as tenants in Common and not as Joint Tenants and to their Several and respective Heirs Executors Administrators and Assigns respectively. And I do hereby declare that my said trustees the said John Permewan and Richard Dennis, their heirs Executors Administrators or Assigns, or any or either of them shall not be charged or chargeable with or accountable for any more money than they may actually receive, or than shall come to their, or either of their hands or power by viryue of this my will, nor with or for any loss which shall or may happen of the said monies or effects, or any part thereof, so as such loss shall happen without their or either of their wilful default or neglect. Nor shall they or either of them be answerable or accountable for the other or other of them, or for the Acts, Deeds,Defaults, Receipts or Disbursements of the other or others of them, but each of themfor his own acts, Deeds, Defaults, Receipts and Disbursements only. And I do furthr declare that my said Trustees, and each of them, and the survivor of them, his Heirs, Executors, Administrators and assigns shall and may deduct and repay, unto themselves and himself out of such monies as shall come to their hands by virtue of this my Will, all such sum an sums of Money, Costs, Charges and Expenses, as they or either of them shall lay out expend or be put unto in the Execution of the Trusts hereby in them reposed.

And I do hereby make, nominate, constitute and appoint the said John Permewan and Richard Dennis Residuary Devisees and Legatees and Executors in Trust of this my last Will and Testament, and Guardians of my said Grand Daughter, Elizabeth Weymouth Kelynack, during her Minority, hereby revoking all former wills by me at any time heretofore made, and declaring this only to be my last Will and Testament.

In Witness whereof I have to this my last Will and Testament written on four sheets of paper subscribed my Hand to the first second and third sheets, and subscribed and set my Hand and seal to this fourth and last sheet this fifth day of August,One thousand, eight hundred and twenty seven.1827
