Will

This is the Last Will and Testament of one Henry Weymouth of Saint Buryan in the County of Cornwall, Farmer.

I give and bequeath unto my nephew John Tregurtha, the younger, Blacksmith, son of John Tregurtha the sum of Twenty Pounds and also my large blue clothes chest.

I give and bequeath unto the children of John Ladner of Sancreed Carpenter as shall be living at my decease, the sum of Twenty Pounds to be equally divided between them and to be paid them by my Executor hereinafter named to their own exclusive use and benefit independent of their Father and without being in any way subject or liable to his control, Debts or Engagements.

I give and bequeath unto my Nephew William Tregurtha of Falmouth, Carrier, the sum of Ten Pounds.

I give and bequeath to my sister in law Margery Thomas, wife of William Thomas, parish clerk of Saint Buryan aforesaid the sum of Five Pounds.

I give and bequeath to John Thomas, son of the aforesaid William and Margery Thomas, Tailor,the sum of Five Pounds.

I give and bequeath to my Nephew William Henry Osborne, son of Thomas Osborne of Pendrea, the sum of Five Pounds, on his attaining the age of twenty one years.

I give and bequeath to my niece Jane Farley wife of Charles farley, of Truro, Mason, the sum of Five Pounds, to her exclusive use, independent of her said husband.

I give and bequeath to Henry Weymouth, son of William Weymouth of Street-an-Nowan, in Paul , Carpenter, the sum of Five Pounds.

I give and bequeath to my niece Ann, the wife of John Phillips of Saint Buryan aforesaid labourer, the sum of Ten Pounds to her exclusive use and benefit independent of her said Husband and without being subject to his control, Debts or Engagements.

And I direct that all the before mentioned several legacies (except the legacy given to William Henry Osborne) shall be paid by my Executor hereinafter named Six Months after my Decease.

I give to my sister in law, Mary Weymouth, of Tolcarne in Madron, Spinster, my Mahogany Chest of Drawers, and my Mahogany Pembroke Table.

I give and devise unto my said sister in law Mary Weymouth from and after my decease my Freehold Messuage Tenement and premises with the appurtenances in Street-an-Mowan aforesaid, in the occupation of francis Dungey or his undertenants To hold the same unto the said Mary Weymouth and to have and receive the rents and Annual proceeds thereof during her natural life, and from and after decease I give and devise the said Freehold Hereditaments and premises unto and to the only use and benefit of my Nephew James Weymouth, son of my late Brother Ephraim Weymouth and to his Heirs and assigns for ever.

I give and bequeath to Charles Jacka of Selena in St.Buryan aforesaid, Farmer, from and after my decease All that my Leasehold Dwelling House and premises in Saint Buryan aforesaid which I now occupy - To hold the same unto the said Charles Jacka his Executors, Administrators and assigns during the remainder of any term and interest therein.

I give to Mary Stone, wife of William Stone of Saint Buryan aforesaid,labourer, and to my said sister in law Mary Weymouth a decent suit of mourning each.

All the rest residue and remainder of my Estates, Monies and securities for money, Plate, Household Furniture, Goods,Chattels, personal estate and Effects whatsoever, subject to the before mentioned several Legacies and to the payment of all my just Debts and Funeral and Testamentory Expenses- I give and bequeath unto my Nephew Henry tregurtha, son of John Tregurtha of Saint Buryan aforesaid- and to his Executors, Administators and Assigns- And I hereby nominate and appoint my said Nephew Henry Tegurtha whole and Sole Executor and residuary Legatee of this my last will and testament hereby revoking all and every former wills or will by me at any time heretofore made and I do declare this only to be my true last will and Testament.- In witness whereof I have hereunto set my hand and affixed my seal this twenty eighth day of April one thousand eight hundred and forty three.

Will

In the Name of God Amen I James Tonjin of the Parish of St.Just in Penwith in the County of Cornwall Yeoman being weake in Body but of sound mind and Memory / blessed be God therefore/ do this twenty fourth day of October in the twenty fourth year of the Reign of our Sovereign Lord George the second of Great Britain France and Ireland King defender of the Faith and so forth and in the year of our Lord one thousand seven hundred and fifty make and publish this my Last will and Testament in manner and form following ( that is to say). First of all, I commend my Soul into the Hands of Allmighty God, who gave it me; and my Body to the Earth from whence it came, in hopes of a Joyfull Resurrection through the Merits of my Saviour Jesus Christ; and as for the wordly Estate wherewith it has pleased God to bless me, I dispose therof as follows:—

First, I give and bequeath unto my Grandson Thomas Grenfell the sum of eighty pounds Sterling money to be paid him by my Executor in Trust herein after named when he shall attain the age of three and twenty years together with the Interest thereof in the mean time provided the said sum be at Interest and the Interest be paid for the same. And if the said Thomas Grenfell shall happen to die before he do attain the age of three and twenty years then the siad sum of eighty pounds to be paid unto his brother and Sister James and Jane Grenfell.

Also, I give and bequeath unto my Grandson James Grenfell brother of the said Thomas Grenfell the sum of sixty pounds, to be paid him also by my Trustee herein aftre named when he shall attain the age of three and twenty years together with the Interest thereof in the mean time, or all such Interest as shall be paid for the said sum in the mean time, And if it shall happen that the said James Grenfell do die before he attain the age of three and twenty years then the said sum of sixty pounds to be paid unto his brother and Sister Thomas and Jane Grenfell.

Also, I give and bequeath unto my Grand Daughter Jane Grenfell sister to the said Thomas and James Grenfell the sum of thirty pounds, to be paid her by my said Executor in Trust herein after named when she shall attain the age of five and twenty, together with all such Interest as shall be paid on the same in the mean time, And if the said Jane Grenfell shall happen to die before she attain the age of twenty five years then the said sum of thirty pounds to be paid equally unto her two brothers the said Thomas and James Grenfell.

Also, I give and bequeath unto my Grandson Thomas Oats son of Thomas Oats the sum of twenty pounds to be paid him by my Executor in Trust hereinafter named when he shall attain the age of three and twenty years.

Also, I give and bequeath unto my Grandson Richard Oats son of Thomas Oats the sum of twenty pounds to be likewise paid him by my in Trust hereinafter named when he shall attain the age of three and twenty years and in case either of the abovementioned Thomas Oats or Richard Oats do happen to die before he shall attain the age of three and twenty years then the Legacie of the Deceased to be paid to the survivor of them.

Also, I give and bequeath unto my Grandson James Tonkin son of James Tonkinof Gurland the house wherein Richard Boyns now lives together with all and singular the Lands and the appurtenances thereunto belonging now in the possession of the said Richard Boyens the which house and lands the said Richard Boyns now holds from me at an Yearly rent, All and singular which said premises are situate lying and being in, and part and parcel of the Tenement of Higher Boswedne in St.Just aforesaid and which I now hold at Lease from the Exect. of Charles Streater Ellis Esq., My Lady Vere Bunt, Thomas Robyns of Penzance Chirwegeon and William Usticke of Leah Gent. by virtue of several leases thereof by them formerly granted To Have and To Hold all and singular the said premises to him my said Grandson James Tonkin his Executors Administrators and Assigns during the remainder of my Estate and Interest therein.

Also, I give and bequeath unto my Granddaughters Grace Tonkin and Esther Tonkin daughters of James Tonkin of Gurland aforesaid the sum of fifteen pounds apiece to be paid them by my Executor in Trust hereinafter named when they shall attain the age of twenty one years together with all such Interest as shall be paid on the same in the mean time and if either of the said Grace and Esther Tonkin shall happen to die before she shall attain the age of one and twenty years the Legacie of the deceased to be paid unto such as shall be then living.

Also, I give and bequeath unto my Granddaughter Thomasin Tonkin daughter of James Tonkin of Gurland the sum of ten pounds to be paid her by my Executor in Trust when she shall attain the age of one and twenty years together with all such Interest as shall be paid on the same in the mean time.

Also, I give and bequeath unto Jane Tonkin daughter of the said James Tonkin the sum of twenty pounds to be paid her by my Executor in Trust when she shall attain the age of one and twenty years together with all such Interest as shall be paid on the same in the mean time., And if either of them the said James Tonkin, Grace Tonkin, Esther Tonkin, Thomasin Tonkin or Jane Tonkin my said Grandchildren shall happen to die before they shall attain the age of one and twenty years that then the Legacie or Legacies of the Deceased to fall equally amongst such of them as shall be living.

Also, I give and bequeath unto my son in law James Tonkin the sum of two shillings and six pence and also I give and bequeath unto my son in law Thomas Oats the sum of two shillings and six pence and to my daughter Jane Oats wife of the said Thomas Oats the sum of two shillings and six pence and to my daughter Grace Tonkin wife of James Tonkin the sum of two shillings and six pence to be paid them by my Executor in Trust within one month after my death.

Also I give and bequeath unto the poor of the parish the sum of twenty shillings to be paid them by my Executor in Trust at Easter next after my death.

Also, I give and bequeath unto my Loving brother Richard Tonkin all my Wearing Apparel of what kind soever to be delivered unto him within the space of Seven Days after my death.

Also, I make constitute and ordain my good Friend and Son in Law Thomas Oats to be my Executor in Trust for my said several Legacies abovementioned, and it is my will that he shall put out what monies I have for their uses in proportion but so as not to be accountable for any bad debt or Debts, that is or shall be contracted, and that if any monies which is now out at Interest or otherwise be not paid, my said Executor in Trust not to be accountable for the same the said several Legatees to deduct proportionably out of their several Legacies and to allow unto my said Executor for all such bad debts, and that my said Executor in Trust shall retain all his charges and Expenses whatsoever in relation to his said Trust, Also I give him five pounds as a token of my Love to him for his kindness in accepting this trust. In Witness whereof I the said James Tonkin have to the first sheet of this my Last Will and Testament containing two sheets of paper Sett my hand, and to the last sheet thereof my hand and Seal the day and year above written.

The 5 daye of October 1640

In the name of God Amen I Thomas Veale of the pishe of St.Just in Penwith Revorkinge all other willes do make this my last will and testament. Beinge in perfecte minde and memorie God be thanked in forme followinge.

Imprimis I bequeath my soule into the hands of the blessed trinity and my bodie to Christian buriall.

It. I give to the Vicker Mr.Mason for forgotten ------[?]

It. I give to the box of the poore of the psish of St.Just

It. I give to the church of the pishe of St.Just

It. I give to every one of my God children

It. I give to my God child Tho. Eva one ewe lambe

It. I give to my sonne John Veale in lieu of a debt that I owe him the one halfe of my best mowe of corne in Calynor ?

It. I give to John Veale my said sonne my two best oxon and two kyne the one blacke and the other redde color to be delivered him forthwith at the time of my death.

It. I give more unto my said sonne John Veale ten sheepe and one blacke colte of 4 years olde and my second best crocke and two panns, the one a ------ pan the other a pan of five galons.

It. I give my said sonne fower silver spoons and my best ---- ----- my ------in the chamber above the entry and two pigges and one sow and one gray mare in the ------ my best ----- ----- and a foweth part of all the butter and cheese thet shall be in the house at the time of my death, and fower ---- -----. all the goods my said sonne is to have forthwith at my dyense day as aforesaid.

It. More I do give unto my said sonne John Veale the one halfe of the debtes thst is owinge me upon bills bounds and other ------ joyntly with my Executor. It. I give him the said John fower platters and three saucers.

It. I give unto my wife Jane Veale two keyne color blacke.

It. I give unto my wife twenty sheepe.

It. I give unto my wife one redde nagge.

It. I give unto my wife two panns the one contayninge ten galons by estem. the other eight galons or there aboute.

It. I give unto my wife one little crocke one chest and one coffer both in one rome and all that is in the said two chestes exceptinge one ----- cape ---- and six spoones of silver.

It. I give unto my wife the best keeve and one tubb and one skillett and 4 platters.

It. I give unto my wife my best bead where I lye and bead clothes belonginge to the same with the furniture.

It. I give unto my wife all her apparell linnin and wollinge.

It. I give unto my wife two yewe gotes two pigges.

It. I give unto my wife the one fourth part of my best mowe of corne in Chy---- [?].

It. I give to Marten Benet my sone in lawe upon this condition that he content himself and not contend with my Executor the sume of ----.

It. I give unto his wiffe Jane on the said condition one pane containinge by estimation eighteen galons and if this be not acepted then I give them but -----.

It. One redde cowe I give unto Glin Veale his 4 daughters and Marten Benet his three children equalie between them.

It. I give to Jane, Marten Benets Daughter one ewe lambe.

It. I give to Hughe Veales children the mony that their Mother oweth me to be paid at ------ next after the date --- beinge.

It. I give to Jane ----- my servant one ----- -----.

It. I give to Glin Veale my sonne the cobard in the said hall.

It. I give to Glin Veale the ----- in the said hall.

It. I also give unto my said sonne Glin my best pan contayninge by estimation 18 galons.

It. I give to Jane, Glin Veales Daughter one hogget.

It. I give unto Marten Benet the fourth part of the butter and cheese in my house.

It. I give to Winniff, John Veales wife one yewe.

It. I give her one chest in the hall.

It. I give John Veale one litle calfe of one year olde.

It. More I give unto my sonne John Veale one candlesticke of brasse and one crocke and one pan of five galons by estem.

It. I give unto my wife Jane all the lambes ---- and one brasen ----sticke and the litle table bord in my chamber and the bord that holdeth cheese in that rome.

It. I give one peere of ---- that is with the ----- unto ------ ------- and Jane, Daughter of Glin Veale.

It. I give unto my sonne John Veale and unto Jane my wife the wheat in the mowhay between them.

It. All the rest of my goods and chattles moveable and unmoveable wett and dry which are not formerly given or bequeathed I do giveand bequeath unto Thomas Veale the sone of Glin Veale and do make him full and whole Executor of this my last will and testament.
